New South Carolina Law Allows Transfer on Death (TOD) Designations for Boats and Motors


Starting July 1, 2025, South Carolina residents can name a Transfer on Death (TOD) beneficiary for their watercraft or outboard motors, thanks to a new law under SC Code Section 62-6-410. This means owners can now designate who will receive their boat or motor upon their death—without going through probate.


How It Works:


Owners must complete the Transfer on Death Designation Application, available on the South Carolina Department of Natural Resources (SCDNR) website. The completed form, along with the original boat title, should be submitted to SCDNR.


When the Owner Passes:


The TOD beneficiary must:


Submit a death certificate,


Complete a watercraft/outboard motor application,


Provide titles or a completed bill of sale,


Present paid property tax receipts from their county of residence, and


Pay applicable transfer fees.


If there’s a lien on the boat or motor, the title will be updated and sent to the lienholder.
